Subscription Terms, Conditions and Disclosures
This document describes the terms, conditions and disclosures of the In My Absence ("IMA") Subscription Plan ("Subscription"). It is not a contract. This plan does not provide insurance.
An IMA Subscription will provide You with the ability to upload short (30s - 60s depending on plan) video messages to our platform, where we will save them for viewing by your intended recipient. This is not intended to be a video hosting services. Rather it is a repository for personal messages, often recorded in the present, and scheduled to be sent at a future time. Your uploaded video messages will be preserved for as long as your account is active. Pre-paid posthumous plans are also available.
Payment of subscription fee is made by the billing source authorized by You in accordance with the payment terms to which You agreed. IMA reserves the right to increase or decrease the subscription fee for each renewal subscription term effective upon renewal of Your subscription. Subscription is not transferable. If You have an individual subscription, only You may use the subscription. If you have a family subscription, only You and Your immediate family may use the subscription. "Immediate family" means You, Your spouse and children living at Your home.
Terminations and Cancellation. You may terminate Your subscription at any time. You can cancel Your subscription online by clicking the Unsubscribe button on your Manage Account page. Your cancellation will be effective promptly upon the receipt of Your cancellation notice.
Governing Law and Arbitration. Your subscription is governed and controlled by the laws of the State of Maryland. Any dispute arising from or related to Your subscription shall be resolved by binding, non-appealable arbitration conducted in accordance with the Rules of American Arbitration Association in Baltimore, Maryland. This provision shall survive the termination of Your subscription and shall be subject to the Federal Arbitration Act.
